

Our "Future Stars" focus is on maintaining and expanding the reach and positive impact that participation in youth sports provides.
The Impact:
In their 2006 research, Jennifer A. Fredricks (Connecticut College) and Jacquelynne S. Eccles (University of Michigan) said that:
*Sports provide a vehicle through which youths can channel their aggression in activities that have rules and norms to guide behaviors.
*Athletics keeps youths in a structured activity setting. As a consequence, they have less time to be involved with problematic peers. Supported by the Women's Sports Foundation who says that highschool girls who participate in athletics are:
**92% less likely to get involved with drugs
**80% less likely to get pregnant
**Three(3) times more likely to graduate than non-athletes
Their results support recommendations for increasing opportunities for youths to participate in a range of extracurricular activities, which can be seen as learning environments with distinct "opportunity structures" for developing personal and interpersonal skills. Extracurricular activities allow students to demonstrate a wider range of skills and interests than is available in most academic contexts.
Unfortunately, sports and school clubs are often viewed as less important than the academic curriculum and are some of the first items to be cut due to fiscal constraints. Educators should reevaluate these assumptions because of the potential developmental benefits of participation in extracurricular activities for many high school adolescents.
The Problem:
A study conducted during the 2008-09 school year estimates that the nation's high schools cut at least $2 billion in funding for athletics. The researcher who signed off on that study, Brian Greenwood, assistant professor at Cal Poly, San Luis Obispo, says he now believes it has grown to "10 times more than that."

Save Our Schools is an ongoing philanthropic initiative operated and managed by a local civic organization and a collaboration of community stakeholders for the purpose of providing emergency funds and resources to schools.
The fiscal challenge facing our nation is having a significant impact on North Carolina Schools. The impact we are experiencing in the marketplace has trickled down to a reduction in public services.
Our schools are now being forced to make dramatic changes in their budgets, which will result in deferred maintenance, a deficiency in teaching resources, and the loss of educators. In the end, we are hurting our children. While there are parents, individuals, and organizations who are working hard to support our schools, it is clear that there is a need for more.
Recently, an alliance of community leaders and socially responsible companies committed to launch a unified effort to Save our Schools. This effort will utilize entrepreneurial creativity and proven strategies to deliver emergency funds to our Schools.
Facts:
•NC ranks 42 in the Nation in the amount of money we spend on our students (2007-2008). We are facing another 16% decrease.
•2009-2011 report shows a loss of 16,253 paid positions in NC public schools
•If we don’t rally as a community to achieve new strategies and solutions, our course of action will be dictated by someone else.
Goals
•Funding: To utilize creative strategies and assist NC Schools by raising funds that will help subsidize school budgets.
•Volunteers: To organize volunteers from the community to help schools and teachers accomplish their goals.
•Government: To communicate with the State and local government as to where we can direct funds and resources to best serve our NC Education System
•Educate: To provide every child the same opportunity to receive an education and graduate from North Carolina Schools.
This coalition has partnered with a banking institution and a non-profit to assure all monies are accounted for and properly distributed. 100% of all donations are distributed to schools and are tax deductible.
This coalition will begin this initiative with 3 components.
1)Save Our Schools Bucket- The “SOS” Bucket is a solicitation for donations and major gifts. A bank account has been established to receive and distribute all donations. Donations may be earmarked for a specific school. 100% of all monies donated are distributed to the schools and are tax deductible.
2)Save Our Schools FunCard- The SOS FunCard was derived by utilizing one of the most popular and familiar fundraising products, a recurring discount/incentive card. The SOS FunCard will be redeemable at thousands of locations on every visit for a 12 month period. 100% of all monies for FunCards are distributed to the schools and are tax deductible. www.adoptaschoolfuncard.com /
3)“Adopt a School”- Adopt a School programs are community initiatives that provide solutions to local schools and have a positive impact on the “whole” community. The SOS Funcard™ is the “Where to go and what to do” discount card. An SOS Funcard™ is a fundamental bond between education, business and the community.
The mission of the Save Our Schools “Funcard” Project™ is to provide schools with an easy, profitable, and ongoing source of funding where the “school” retains 100% of all monies. The “Funcard” project improves the opportunity to make up for the shortfalls of local and state funding. The FunCard project also bypasses the worries and other non-traditional revenue “profit-share” campaigns associated with typical fundraisers.
*SOS FunCard - A recurring discount/incentive card redeemable at thousands of locations on every visit for a 12 month period. Cards are sold for $20 each. Participating schools retain total $20.
Here’s how The Ideal SOS FunCard Fundraiser works:
* Save Our Schools "SOS Funcards" (look and function like a typical grocery store loyalty card) and provides card holders with valuable discounts & incentives on their everyday purchases to hundreds of businesses each visit. (example: Buy One Get One Free Pizza, $5 off Oil Change, Free Kids meal, 20% off Dry Cleaning, Carwash, Car Rentals, Movies, Grocery Store Coupons, etc). There will be 20 business discounts on the back of the card that represent businesses in the cardholder’s immediate community. Card-holders also have thousands of discounts and incentives available to you locally and across the United States
FunCards costs $20 a year
Schools receive all $20 and incur no costs.
Cards can be purchased: online, participating schools, and business and organization “distribution partners”.
Campaign Example:
Average 1,000 students (or parents, local organizations, and businesses) per school participate:
Each student or community partner sells 5 Funcards each @ $20 ($100)
Min. raised is $100,000.00 per school
All monies raised are distributed to school of card-buyers choice.
On behalf of the school, Save Our Schools coalitions sends each FunCard holder a monthly Thank you message, a free gift, and a list of new business participants that offer discounts and incentives. (This strategy fosters a “relationship” between the school and the FunCard Holder). On the 12 month we send a renewal notice to the card holder allowing them to renew instantaneously. In a perfect world this will net the school $100,000.00 before they begin their next FunCard campaign. Our guestimate is the renewal rate will be approximately 40% or $40,000.00
Year 2, estimated $40,000 renewals and $80,000 new sales (4 cards ea) $120k.
Project Needs:
a) Businesses to provide incentives
b) Media to promote campaign,
c) Admin Volunteers,
d) Community Leaders to help spread the word.
Strategies:
1)By 2015, to secure a $20 (FunCard) sponsorship per student in NC schools. We will encourage partnerships from local media, businesses, community leaders, parents, organizations, and churches to sponsor and promote to sponsor every child in our NC schools by purchasing 1 FunCard per child. This effort would allow us to inject $50M per year in our NC schools.
2)By 2020, to establish a community Adopt a School program for every NC school. Alleviating a minimum expenditure of $10,000 per year per school, by allowing volunteers to assist schools in mentoring, tutoring, student services, job placement programs, school resources, and assistance with the grounds and maintenance. This effort would allow us to save from the States budget $23M per year in our NC Schools
3)By 2020 to secure a minimum of $10,000 per year per school from corporate and small business donations and sponsorships. This effort would allow us to inject $23M per year in our NC schools.

Thanks "Giving" Day
What: Annual Thanksgiving turkey drive
When: Saturday, November 22
Where: Volunteers will be collecting frozen turkeys, non-perishable food, and donations at locations in Wake County, Durham County, Mecklenburg County, and New Hanover County. Volunteers will be in the parking lots of the drop-off locations between 9 a.m. and 2 p.m. Look for Generous Community banners to locate the drop-off point.

The turkeys and other donations will help the Generous Community to provide a traditional Thanksgiving dinner and other holiday meals to those in need, and to be there for those in need after the holidays.
"The FoodBank is in a crisis situation with food supplies shrinking at the same time that more and more people are turning to emergency food providers for help. This drive has to be about a 'Turkey and More' if we are going to be able to meet the need throughout the winter long after the holidays over," says Ross Blaising, Generous Community Volunteer.
"Our annual ‘Thanks GIVING Day’ drive is taking place when we are in the worst economic times in years for those we serve and for those who support us. Please talk to your family, friends, co-workers, houses of worship and ask them to help--we need to have as many as possible involved. Whether in the form of a frozen turkey, canned goods, or a cash donation, we need your support now more than ever before," says Blaising.
Last year, Generous Community distributed more than 1,000 turkeys and other groceries, ultimately serving low-income seniors, children, the disabled, battered women, the homeless and working poor families in 10 counties.
Generous Community is encouraging financial donations, which will be used to purchase turkeys at wholesale prices and assist the Generous Community in distributing food and groceries throughout the winter months when the number of families needing help increases greatly. Checks made out to Generous Community can dropped off at turkey collections sites or be mailed to Generous Community, 7128 Falls Glen Court, Suite 200 Raleigh, NC 27614. Please write "Thanks GIVING Day" on the outside of the envelope.

The current fiscal challenges facing our nation have, and will continue to have, a significant impact on your city and state. As economic projections reflect a slowdown in our economy, we begin to feel the impact through cuts in hours, wages, and even jobs. Government often responds with higher taxes and fees, a reduction in public services, and calls to look out for even deeper cuts to follow.
Under these conditions, our public, charter, and private schools are generally forced to make dramatic changes in their budgets, often resulting in deferred maintenance, a deficiency in teaching resources,and the loss of educators. In the end, we are shorting our children, who might otherwise benefit from cleaner schools, access to broader programs and modern technologies, and smaller class sizes. While there are parents, individuals, and organizations who are working hard to support our schools, it is clear that there is a need for more.
October 1, 2011 will be the third National Adopt-A-School Day. Adopt-A-School Day is a nationwide grassroots effort to establish an annual day of awareness and service to US schools. On October 1, generous people in every community in the USA will assist schools in their zip codes following a simple 3 part formula:
1. Pick a school in your zip code you have an interest in helping.
2. Ask how you can help on Adopt-A-School Day (October 01, 2011)
3. Organize your group and lend a hand.
This community service day makes no distinction between public/charter/private schools, nor grade levels. This is a day for the community to support all of our schools. Projects include donations,beautification, implementing a new school program, fundraising, backpack drives, career skills training,and more.
This year, we are asking generous people like you to support schools in their zip codes and in addition,we will be serving as a catalyst to expand the scope and impact of the Adopt- A-School Day Nationwide. The Generous Community Student Board will be handling the promotion and publicity of this truly unique effort to establish an annual day of service when we invest one day for our future.

Getting Started
While no two projects will be the same, successful projects will share a few common practices. We encourage you to incorporate the following elements into your service project:
•Create a team with your friends and neighbors to share the effort
•Set outcome-based goals and track your progress to those goals
•Celebrate your successes together
The Challenge: Many community-based organizations do not have enough capacity to manage a large number of volunteers, so they need you to organize yourself in coordination with them. This tool kit is designed to either help you organize a group and be a positive addition to a Generous Community Chapter, or, if such an organization does not exist, to be a well-organized independently-run group that fills a needed gap in the community.
A step by step guide to getting started and executing service activities follows. Please let us know how your project goes and what you learn by telling your story
Step One: IDENTIFY LOCAL NEEDS
No one knows your community better than you and your neighbors do. Take proactive steps to address the challenges you see daily and generate solutions that work in your neighborhood. Whether you and your team decide to partner with the “Save Our Schools” campaign begin an “Adopt a School” initiative or to organize meal distribution at a community center, you already have the resources you need to get started.
•Find out what’s already happening in your community. If you see a service gap, consider creating your own project.

Set a service goal and hold yourself accountable. Commit as individuals and as a team to making a measurable impact. Set your goals high to stretch yourself. You’ll be surprised at how much you can do when you commit, focus, and follow through.

You share our passion. You have ideas about how to improve your part of the world. And you know people who are willing to help. But there isn't a Generous Community Chapter near you. Don't worry. That's exactly how many of our Chapters get started.
Choosing a Chapter Format
While community-based “Chapters” are our tradition, we realize that one size does not fit all. That's why we offer several Chapter formats for you to choose from:
•Traditional Generous Community Chapters are ideal for bringing together a group of community-minded people to serve the needs of their community in any way – and can be formed anywhere.
•New Century Generous Communitys are designed for young adults who are age 35 or younger at the time of club formation, and offer flexibility to fit busy lifestyles. Members meet and volunteer as their schedules permit – and rely on Web resources to communicate and perform club administration.
•Campus Generous Communitys are designed for college and university students, administrators, faculty, alumni and other community-minded individuals. Members serve the campus community while developing valuable leadership and business skills.
•Club Chapters enable a small group of people to form a Generous Community and start making a difference in their community sooner. Members become part of an existing "parent" Generous Community, but select their own projects and activities.
You can also start a new Generous Community based on your interests or circumstances:
•Perhaps you have a hobby you enjoy, a community project you'd like to work on or want to volunteer with business colleagues. If so, a Special Interest Generous Community could be right for you.
•Maybe you'd like to organize a club that includes members from distant geographic areas – or holds club meetings online for convenience. If so, a Cyber Generous Community will help you organize a club through the Internet.
•Or, you might prefer to work on projects that serve schools. If so, a Champions Generous Community in support of “Adopt a School” might be a good choice for you.
Whatever the case, we will help you start a Generous Community that works best for you and your community.

Currently our medical outreach programs are offered during our National Generous Weekend campaign which occurs every year on the 3rd Weekend in May.

Backpack Program
Thousands of children are in school without basic school supplies. Some schools are over-crowded and dilapidated, crippling the future of the nation. Over the past few years, hundreds of students have dropped out of school to help earn income for their struggling families. These children are faced with the challenge of trying to learn in a classroom without basic school supplies. Will you help?
Generous Community's "National Backpack Program" provides "at-risk" school children with a new backpack for the upcoming school year. Our goal is to make a difference in the communities where we have Generous Community Chapters.
Every summer we campaign to provide backpacks to children in the United States and internationally at the beginning of the traditional school year. Backpacks are distributed through several national charities focused on education, disaster relief, violence and domestic abuse, many of which actively work with local schools and non-profit organizations nationally.

Since 1997 it is estimated that Kids Exchange event has supplied over $6M in clothing, baby equipment and supplies, maternity supplies, and financial gifts to thousands of underprivileged mothers, expecting, mothers, children, and churches and organizations that serve the aforesaid.
The Kids Exchange is a compilation of approximately 4,000 families and their gently used baby, children, and maternity items, more than 300 volunteers, and almost 100 paid personnel each show (every January and July). www.KidsExchange.net
Our mentoring programs with children in our school systems allow us to build relationships with families. As we do, our events like the Kids Exchange allow us to provide assistance inside the home.

Bring Them In, Build Them Up, and Send Them Out
Bring Them in: Generous Community brings in students from all walks of life. We use conferences, awards ceremonies, sports, hobbies, talents, community service, and activities of interest to get them involved.
Build Them Up: We love them and teach them to love each other. We interact with one another. We encourage, motivate, and support them in every aspect of their lives. We get involved. We build a relationship with them. We promote community. We become a TEAM. We teach them how to set and attain goals. We teach them how to communicate and utilize all resources available to them. And we teach them to expect to succeed in everything they attempt (school, sports, careers, relationships, etc).
They experience, passion, compassion, integrity, team building, goal setting, and overall personal growth and sense of accomplishment
Send Them Out: We send them out as leaders equipped to make great accomplishments in their schools, teams, families, communities, and their personal lives. We send them out as the examples of morals, ethics, and social responsibility. We send them out as mentors that get others involved so that their lives may be enhanced in some way. We send them out to make a difference!
As an Association, “Generous Community” wants to impact the lives of people by providing learning facilities/opportunities and educational programs that promote character development, life-enhancing values, and relationships (Life Skills). Through the Life Skills Experience, participants learn valuable lessons about the importance of maintaining a positive attitude; how to make decisions by thinking about the possible consequences and how to define and set goals from the Generous Community and “Adopt a School” projects to everyday life.
The Life Skills Experience is one of the unique features that differentiate The Generous Community Student Board of Directors from many other successful student activities, teams, and programs. Through creative concepts we tie in the experiences of the students to forward the “GC” Mission of caring for the needy of the world.

Generous Community.net Terms of Use Agreement

GenerousCommunity.net is a professional networking service dedicated to the "Humanitarian and Philanthropic Industries" that allows Members to create unique personal profiles online in order to find and communicate with others within "The Industry". The services offered by GenerousCommunity.net ("Generous Community" or "we") include the Generous Community.net website (the "Generous Community Website"), the Generous Community.net Internet messaging service, and any other features, content, or applications offered from time to time by GenerousCommunity.net in connection with the Generous Community Website (collectively, the "Generous Community Services"). The Generous Community Services are hosted in the U.S.
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Generous Community Services. By using the Generous Community Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Generous Community Website) or you are a "Member" (which means that you have registered with GenerousCommunity.net). The term "User" refers to a Visitor or a Member. You are only authorized to use the Generous Community Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the Generous Community Website and discontinue use of the Generous Community Services immediately. This Agreement includes GenerousCommunity.net's policy for acceptable use of the Generous Community Services and Content posted on the Generous Community Website, your rights, obligations and restrictions regarding your use of the Generous Community Services and GenerousCommunity.net's Privacy Policy. In order to participate in certain Generous Community Services, you may be notified that you are required to download software or content and/or agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to the Generous Community Services in which you choose to participate, those additional terms are hereby incorporated into this Agreement. You may receive a copy of this Agreement by emailing us at: privacy@GenerousCommunity.net, Subject: Terms of Use Agreement.
GenerousCommunity.net may modify this Agreement from time to time and such modification shall be effective upon posting by GenerousCommunity.net on the Generous Community Website. You agree to be bound to any changes to this Agreement when you use the Generous Community Services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.
Please choose carefully the information you post on GenerousCommunity.net and that you provide to other Users. Your GenerousCommunity.net profile may not include the following items: telephone numbers, street addresses, last names, and any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other GenerousCommunity.net Members (for instance, in their Profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and GenerousCommunity.net assumes no responsibility or liability for this material. If you become aware of misuse of the Generous Community Services by any person, please contact Generous Community or click on the "Report Inappropriate Content" link at the bottom of any GenerousCommunity.net page.
GenerousCommunity.net reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Generous Community Services at any time, for any or no reason, with or without prior notice, and without liability.
1. Eligibility. Use of and Membership in the Generous Community Services is void where prohibited. By using the Generous Community Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 14 years of age or older; and (d) your use of the Generous Community Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under 14 years of age.
2. Term. This Agreement shall remain in full force and effect while you use the Generous Community Services or are a Member. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. GenerousCommunity.net may terminate your Membership at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect, including sections 5-17.
3. Fees. You acknowledge that GenerousCommunity.net reserves the right to charge for the Generous Community Services and to change its fees from time to time in its discretion. If GenerousCommunity.net terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
4. Password. When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify GenerousCommunity.net immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
5. Non-commercial Use by Members. The Generous Community Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Generous Community. Illegal and/or unauthorized use of the Generous Community Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Generous Community Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the Generous Community Services.
6. Proprietary Rights in Content on GenerousCommunity.net.
1. GenerousCommunity.net does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you post to the Generous Community Services. After posting your Content to the Generous Community Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing ("posting") any Content on or through the Generous Community Services, you hereby grant to GenerousCommunity.net a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the Generous Community Services.
Without this license, GenerousCommunity.net would be unable to provide the Generous Community Services. For example, without the right to modify Member Content, GenerousCommunity.net would not be able to digitally compress music files that Members submit or otherwise format Content to satisfy technical requirements, and without the right to publicly perform Member Content, GenerousCommunity.net could not allow Users to listen to music posted by Members. The license you grant to GenerousCommunity.net is non-exclusive (meaning you are free to license your Content to anyone else in addition to GenerousCommunity.net), fully-paid and royalty-free (meaning that GenerousCommunity.net is not required to pay you for the use on the Generous Community Services of the Content that you post), sublicensable (so that GenerousCommunity.net is able to use its affiliates and subcontractors such as Internet content delivery networks to provide the Generous Community Services), and worldwide (because the Internet and the Generous Community Services are global in reach). This license will terminate at the time you remove your Content from the Generous Community Services. The license does not grant GenerousCommunity.net the right to sell your Content, nor does the license grant GenerousCommunity.net the right to distribute your Content outside of the Generous Community Services.
2. You represent and warrant that: (i) you own the Content posted by you on or through the Generous Community Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the Generous Community Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Generous Community Services.
3. The Generous Community Services contain Content of GenerousCommunity.net ("GenerousCommunity.net Content"). GenerousCommunity.net Content is protected by copyright, trademark, patent, trade secret and other laws, and GenerousCommunity.net owns and retains all rights in the GenerousCommunity.net Content and the Generous Community Services. GenerousCommunity.net hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the GenerousCommunity.net Content (excluding any software code) solely for your personal use in connection with viewing the Generous Community Website and using the Generous Community Services.
4. The Generous Community Services contain Content of Users and other GenerousCommunity.net licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Generous Community Services.
7. Content Posted.
1. GenerousCommunity.net may delete any Content that in the sole judgment of GenerousCommunity.net violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. GenerousCommunity.net assumes no responsibility for monitoring the Generous Community Services for inappropriate Content or conduct. If at any time GenerousCommunity.net chooses, in its sole discretion, to monitor the Generous Community Services, GenerousCommunity.net nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
2. You are solely responsible for the Content that you post on or through any of the Generous Community Services, and any material or information that you transmit to other Members and for your interactions with other Users. GenerousCommunity.net does not endorse and has no control over the Content. Content is not necessarily reviewed by GenerousCommunity.net prior to posting and does not necessarily reflect the opinions or policies of GenerousCommunity.net. GenerousCommunity.net makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or information that you transmit to other Members.
8. Content/Activity Prohibited. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the Generous Community Services. GenerousCommunity.net reserves the right to investigate and take appropriate legal action against anyone who, in GenerousCommunity.net's sole discretion, violates this provision, including without limitation, removing the offending communication from the Generous Community Services and terminating the Membership of such violators. Prohibited Content includes, but is not limited to Content that, in the sole discretion of GenerousCommunity.net:
1. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
2. harasses or advocates harassment of another person;
3. exploits people in a sexual or violent manner;
4. contains nudity, violence, or offensive subject matter or contains a link to an adult website;
5. solicits personal information from anyone under 18;
6. provides any telephone numbers, street addresses, last names, URLs or email addresses;
7. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
8. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
9. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
10. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
11. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
12. solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
13. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
14. includes a photograph of another person that you have posted without that person's consent; or
15. for band and filmmaker profiles, uses sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile.
The following is a partial list of the kind of activity that is illegal or prohibited on the Generous Community Website and through your use of the Generous Community Services. GenerousCommunity.net reserves the right to investigate and take appropriate legal action against anyone who, in GenerousCommunity.net's sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:
1. criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
2. advertising to, or solicitation of, any Member to buy or sell any products or services through the Generous Community Services. You may not transmit any chain letters or junk email to other Members. It is also a violation of these rules to use any information obtained from the Generous Community Services in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, GenerousCommunity.net reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which GenerousCommunity.net deems appropriate in its sole discretion. If you breach this Agreement and send unsolicited bulk email, instant messages or other unsolicited communications of any kind through the Generous Community Services, you acknowledge that you will have caused substantial harm to GenerousCommunity.net, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay GenerousCommunity.net $50 for each such unsolicited email or other unsolicited communication you send through the Generous Community Services;
3. covering or obscuring the banner advertisements on your personal profile page, or any GenerousCommunity.net page via HTML/CSS or any other means;
4. any automated use of the system, such as using scripts to add friends or send comments or messages;
5. interfering with, disrupting, or creating an undue burden on the Generous Community Services or the networks or services connected to the Generous Community Services;
6. attempting to impersonate another Member or person;
7. for band profiles, copying the code for your Generous Community Player and embedding it into other profiles or asking other Members to embed it into their profiles;
8. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
9. selling or otherwise transferring your profile;
10. using any information obtained from the Generous Community Services in order to harass, abuse, or harm another person;
11. displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the Generous Community Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your "Top 8" friends, or sending private messages with a commercial purpose; or
12. using the Generous Community Services in a manner inconsistent with any and all applicable laws and regulations.
9. Copyright Policy. You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of GenerousCommunity.net to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to GenerousCommunity.net by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Generous Community Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Generous Community Services; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. 10. Member Disputes. You are solely responsible for your interactions with other GenerousCommunity.net Members. GenerousCommunity.net reserves the right, but has no obligation, to monitor disputes between you and other Members.
11. Privacy. Use of the Generous Community Services is also governed by our Privacy Policy, which is incorporated into this Agreement by this reference.
12. Disclaimers. GenerousCommunity.net is not responsible for any incorrect or inaccurate Content posted on the Generous Community Website or in connection with the Generous Community Services, whether caused by Users of the Generous Community Services or by any of the equipment or programming associated with or utilized in the Generous Community Services. Profiles created and posted by Members on the Generous Community Website may contain links to other websites. GenerousCommunity.net is not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by GenerousCommunity.net. Inclusion of any linked website on the Generous Community Services does not imply approval or endorsement of the linked website by GenerousCommunity.net. When you access these third-party sites, you do so at your own risk. GenerousCommunity.net takes no responsibility for third party advertisements which are posted on this Generous Community Website or through the Generous Community Services, nor does it take any responsibility for the goods or services provided by its advertisers. GenerousCommunity.net is not responsible for the conduct, whether online or offline, of any User of the Generous Community Services. GenerousCommunity.net is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the Generous Community Services or combination thereof, including any injury or damage to Users or to any person's computer related to or resulting from participation or downloading materials in connection with the Generous Community Services. Under no circumstances shall GenerousCommunity.net be responsible for any loss or damage, including personal injury or death, resulting from use of the Generous Community Services, attendance at a GenerousCommunity.net event, from any Content posted on or through the Generous Community Services, or from the conduct of any Users of the Generous Community Services, whether online or offline. The Generous Community Services are provided "AS-IS" and as available and GenerousCommunity.net expressly disclaims any warranty of fitness for a particular purpose or non-infringement. GenerousCommunity.net cannot guarantee and does not promise any specific results from use of the Generous Community Services.
13. Limitation on Liability. IN NO EVENT SHALL GenerousCommunity.net BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF GenerousCommunity.net HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, GenerousCommunity.net'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO GenerousCommunity.net FOR THE Generous Community SERVICES DURING THE TERM OF MEMBERSHIP.
14. U.S. Export Controls. Software available in connection with the Generous Community Services (the "Software") is further subject to United States export controls. No Software may be downloaded from the Generous Community Services or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk.
15. Disputes. If there is any dispute about or involving the Generous Community Services, you agree that the dispute shall be governed by the laws of the State of California, USA, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of California, City of Los Angeles. Either GenerousCommunity.net or you may demand that any dispute between GenerousCommunity.net and you about or involving the Generous Community Services must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in Los Angeles, California, USA, provided that the foregoing shall not prevent GenerousCommunity.net from seeking injunctive relief in a court of competent jurisdiction.
16. Indemnity. You agree to indemnify and hold GenerousCommunity.net, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Generous Community Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Generous Community Website or through the Generous Community Services causes GenerousCommunity.net to be liable to another.
17. Other. This Agreement is accepted upon your use of the Generous Community Website or any of the Generous Community Services and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and GenerousCommunity.net regarding the use of the Generous Community Services. The failure of GenerousCommunity.net to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. GenerousCommunity.net is a trademark of Generous Community, Inc. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
